Al, here's another for you. If you happen to be the area over the next months, could you take a picture of this farm / farms. I had put a vision in my head as I transcribed the Last Will & Testament.
Mike - I thought you would like to read the Last Will for fun. Interesting both James and Mary died on the 30th day of March in different years.

1. JAMES DANIEL KENNEDY was born Abt. 1804 in Ireland, and died March 30, 1882 in
Nepean Township, Carleton County, Province of Ontario. He married MARY COOK(E) March 02,
1835 in Notre Dame Basilica, Ottawa, Carleton County, daughter of GEORGE COOK(E) and SARAH
(CHADWICK).
Notes for JAMES DANIEL KENNEDY:
Note that the name "DANIEL" was taken from the record of baptism of his daughter ANNIE.
Buried in St. Patrick's RC Church Cemetery in Fallowfield and the Inscription reads as follows;
James Kennedy, died March 30, 1882, aged 78 years
His wife, Mary, died March 30, 1900, aged 87 years
Annie, died April 28, 1886, aged 38 years

UNTO THE SURROGATE COURT OF THE COUNTY OF CARLETON
The Petition of Mathew O'Connor in the Township of North Gower in the County of
Carleton, Yeoman, and John O'Callaghan the younger of the same place, License Inspector.
Humbly Sheweth - That JAMES KENNEDY late of the Township of North Gower in the County
of Carleton, yeoman deceased, died on or about the Thirtieth day of March in the
year of Our Lord one thousand eight hundred and eighty two at the Township of North Gower
in the County of Carleton and that the said deceased at the time of his death has
a fixed place of abode in the said Township of North Gower in the County of Carleton.
That the said deceased in his lifetime duly made his Last Will and Testament bearing
the date the Eleventh day of July in the year of Our Lord one thousand eight hundred
and seventy eight.
That your Petitioners are the executors named in the said Will. That the value of
the personal estate and effects of the said deceased which in any way died possessed
of or entitled to, and for and in respect to which Probate of the said Will is to
be granted are of or about the value of xxxx to the best of your Petitioners
knowledge and belief.
Wherefore your Petitioners pray that Probate of the said Will of the said
deceased may be granted to them by this Honorable Court dated the 24th day of March A.D. 1883.

LAST WILL & TESTAMENT
I JAMES KENNEDY in the Township of North Gower in the County of Carleton in the
Province of Ontario, yeoman, being of sound mind and memory and of disposing judgment
and considering the uncertainty of this transitory life do make, contain, publish
and declare this to be my Last Will and Testament hereby revoking all former Wills
and Testaments by me made.
First after all my just debts, funeral, Testamentary and other costs and charges
are paid, the residue of my estate both real and personal, I give, devise,
bequeath and dispose of as follows, that is to say…
To my son LEWIS KENNEDY his heirs and assigns forever, I give, devise and bequeath
all and singular that certain parcel or tract of land and premises situate,
lying and being in the Township of North Gower in the County of Carleton in the
Province of Ontario and Dominion of Canada containing by admeasurements one hundred
acres be the same more or less and being composed of the South half of Lot Number
Seventeen in the Fourth Concession of the said Township of North Gower but subject
however to the terms and conditions and the payment of the legacies and annuities
hereinafter mentioned and expressed.
To my son LUKE KENNEDY his heirs and assigns forever, I give, devise and bequeath
all and singular that certain parcel or tract of land and premises situate, lying
and being in the Township of North Gower in the County of Carleton in the Province
of Ontario and Dominion of Canada containing by admeasurements one hundred acres
be the same more or less and being composed of the South half of Lot Number Seven
in the Third Concession of the said Township of North Gower but subject however to
the terms and conditions and the payment of the legacies and annuities hereinafter
mentioned and expressed.
To my son JOHN KENNEDY his heirs and assigns forever, I give, devise and bequeath
all and singular that certain parcel or tract of land and premises situate, lying
and being in the Township of North Gower in the County of Carleton in the Province
of Ontario and Dominion of Canada containing by admeasurements fifty acres be the
same more or less and being composed of the Rear half of the North half of Lot
Number Twelve in the Second Concession of the said Township of North Gower but
subject however to the terms and conditions and the payment of the legacies and
annuities hereinafter mentioned and expressed.
To my beloved wife MARY KENNEDY and to each of my daughters JANE KENNEDY,
MARGARET KENNEDY, ANNIE KENNEDY and THERESA KENNEDY for and during their natural
lifetime, I give and bequeath a home at my residence the use of my dwelling house,
wood shed, old milk house with the South half of the Fraser Barn or cowhouse and the
left overhead and the kitchen garden now in use, the half acre or corn patch at the
front door of my dwelling house and the half acre now used as a hay pasture lying
between the buildings upon my premises and the lands of WILLIAM MOFFAT and the said
pieces of ground to be properly prepared and planted each year with such crop or
crops as they may desire, together with the use of one half of the sugar bush.
To my said wife and to each of my said daughters JANE KENNEDY, MARGARET KENNEDY,
ANNIE KENNEDY and THERESA KENNEDY I give and bequeath one cow and two ewes the same
to be any they may choose to select out of my stock, together with food and wholesome
pasture in summer and the same of the barnyard (or feed from such straw as may be
grown upon the premises from year to year) in the winter and one ton of good turned
hay for each to be placed upon the cowshed loft annually and used by them as they
may think fit and should any cow or cows die or be disabled in any way, so owned
by my aforesaid wife or daughters the same shall be placed at the expense of my
said son LEWIS KENNEDY. To my said beloved wife and my daughters JANE KENNEDY,
MARGARET KENNEDY, ANNIE KENNEDY and THERESA KENNEDY I give abd bequeath cojointly
the sum of xxxx dollars per annum, together with twenty five cords of good wood the
said wood to be piled and out ready for use in my woodshed. An further I give and
bequeath to my beloved wife and daughters JANE KENNEDY, MARGARET KENNEDY, ANNIE
KENNEDY and THERESA KENNEDY all my household furniture, stoves, beds and bedding,
dogurn etc., of which I may be seized or possessed at the time of my death. To each
of my aforesaid daughters in the event of their marriage but not otherwise I give
and bequeath the sum of xxxx dollars together with a good and respectable outfit
such in one as is used for girls in their circumstances to have, the said sum of
xxxx dollars to be paid to them in two payments within one and two years respectively
after such marriage by my aforesaid sons in the following proportion that is to say my
son JOHN KENNEDY to pay the sum of xxx dollars. My said son LUKE KENNEDY the sum of xxx
dollars and my said son LEWIS KENNEDY to provide the aforementioned outfit and pay
the sum of xxx dollars and in the event of any of my said daughters marrying their
proportion of the annuity and interest and home at my residence and use of lands
and buildings herein before expressed shall immediately cease and determine and
should the number of the members of my family by death or marrying be reduced to two
then and in that case the annuity so mentioned shall be xxx dollars per annum and
further should sickness or death occur to any of my aforesaid family while residing
at my residence all debts, bills, funeral and other costs and charges are to be paid
for them independent of the aforementioned annuity.
To my daughter SARAH HART ....

To my son JOHN KENNEDY I give and bequeath all the personal effects, agricultural
implements, horses etc. now held and used by him.
To my son LUKE KENNEDY I give and bequeath all the personal effects, agricultural
implements, horses etc. now held and used by him.
And should my present place of residence be accidentally destroyed by fire or
otherwise then and in that case my said son LEWIS KENNEDY shall immediately erect a
good and comfortable house and other buildings for the accommodations of my said
beloved wife and daughters to reside therein and it is my wish and desire that my
said beloved wife and daughters shall at all times have ingress and egress, to and
from my place of residence and through and over all fields necessary for them to
travel both for themselves and all teams, vehicles and visitors whilst they may have.
Notes for MARY COOK(E):
Also on March 2, 1835, a Conditional Baptism for Mary Cook who may have formerly been
received in the Catholic Church, aged 20 years, daughter of George Cook and Sarah Chaddick
(Chadwick) by the Rev'd T. O'Meara, in Notre Dame Basilica in Ottawa. The witnesses were
Daniel Boyle and Rebecca Cook.
